Tattoomii: General Terms and Conditions (GTC) / Impressum

Welcome to Tattoomii. The following General Terms and Conditions govern the use of our digital platform by tattoo artists ("Artists") and tattoo enthusiasts ("Users"). These GTC are designed to clearly outline rights, obligations, and responsibilities, and to ensure a safe, transparent, and fair marketplace for the tattoo community.
1. Scope and Definitions
These General Terms and Conditions (GTC) apply to all services of the Tattoomii platform, accessible at www.tattoomii.com, www.tattoomii.ch, www.tattoomii.de, as well as all related features and communication services.
Platform Purpose: Tattoomii provides a digital marketplace that enables Users to: find tattoo artists and view their profiles, explore portfolios, images, and information about artistic styles and working methods, receive non-binding price indications for tattoo ideas, get in direct contact with Artists.
Definitions
A self-employed individual or studio offering professional tattoo services.
A natural person who uses the platform to find Artists, obtain price orientation, or seek inspiration.
All content uploaded by Artists, Users, or Tattoomii, including images, text, videos, or other media.
Contract Note: Tattoomii is not a tattoo studio, not a provider of tattoo services, and not a contractual partner for any services agreed between Artists and Users.
2. Role of Tattoomii
Tattoomii solely provides the digital infrastructure to connect Artists and Users. Tattoomii is not involved in service delivery and assumes no responsibility or liability for arrangements, agreements, or outcomes between Users and Artists.
Not Provider: In particular, Tattoomii is not: a provider or performer of tattoo services, a contractual party to any tattoo assignment, a medical advisor, a personnel placement or staffing service, a guarantor for prices, quality promises, or appointment agreements.
Agreement Note: All agreements regarding tattoo services, including pricing, execution, risks, and aftercare, are made directly between Artist and User and lie outside Tattoomii's responsibility.
3. Tattoomii Services
3.1 Artist Profiles
Users can view Artist profiles, browse portfolios, and learn about styles and specialisations. Artists are responsible for the accuracy and completeness of their information.
3.2 Price Calculator
The price calculator provides an indicative estimate of a potential price range. This estimate is based on generic data points and does not constitute an offer or binding price. Actual prices are determined solely by the Artist.
Ai Note: To categorise tattoo ideas, the price calculator may use AI-powered image analysis and text recognition (see Section 15: Artificial Intelligence).
3.3 Verified Artists
Tattoomii may label Artists as "verified" based on internal criteria (e.g., portfolio quality, professionalism, technical execution). Verification is not a guarantee of: quality of service, artistic performance, legal, professional, or medical certification.
3.4 Booking and Calendar Features
Tattoomii provides optional booking and calendar features that allow Artists to schedule tattoo appointments and synchronise them with their Google Calendar. Additionally, video meetings (via Google Meet) can be created for consultations.
Disclaimer Note: These features serve solely as organisational support. Tattoomii is not a contractual party to appointments arranged between Artists and Users and assumes no liability for cancellations, rescheduling, or no-shows.
3.5 Messaging and Chat
Tattoomii provides an integrated messaging system that allows Users and Artists to communicate directly. Messages may contain text and file attachments (images, documents). Chat rooms are created per project or consultation.
Storage Note: Messages are stored on Tattoomii's servers to facilitate communication. Information on storage duration and deletion can be found in our Privacy Policy.
Responsibility Note: Tattoomii assumes no responsibility for the content of messages between Users and Artists.
3.6 Reviews
Users can rate Artists and leave experience reports. Reviews must be truthful and fair. Artists and Users can report inappropriate reviews.
Moderation Note: Tattoomii reserves the right to moderate, edit, or remove reviews that violate these GTC, are offensive, misleading, or legally problematic.
3.7 Role Switching
Registered users can switch between the Customer and Artist roles. When switching roles, existing data and content are retained as long as they are compatible with the new role.
Verification:
Artists may be verified by Tattoomii based on defined quality standards. Verification does not guarantee specific results or quality of services.
No Direct Booking:
Tattoo appointments and contracts are arranged solely between Users and Artists.
No Guarantee:
Tattoomii does not guarantee the availability, quality, or outcome of tattoo services.
4. Conditions of Use
4.1 General Requirements
User Costs: The platform is free of charge for Users.
Artist Costs: Artists also currently use Tattoomii free of charge; future fee-based models may be introduced.
Accuracy: All submitted information must be complete and accurate.
4.2 Age Requirements
The platform may be used without a specific age restriction. Users are responsible for complying with legal requirements applicable to them. Artists bear sole responsibility for verifying that clients meet the legally required minimum age before performing any tattoo service.
4.3 Account Requirements
User and Artist accounts must not be misused. The following are prohibited: fake accounts, identity concealment, unauthorised use of other accounts, any form of fraud or deception.
User Costs: The use of the platform is free of charge for Users.
Artist Costs: The use of the platform is currently free of charge for Artists. Tattoomii reserves the right to introduce fees (e.g. for subscriptions or premium features) in the future, with reasonable notice.
Price Adjustment: Tattoomii reserves the right to adjust prices and fees with reasonable notice.
5. Obligations of Artists
Obligations
- upload only their own images, works, and content
- avoid misleading or manipulated representations
- provide truthful information about prices, styles, and services
- refrain from giving medical, legal, or guaranteed-outcome statements
- comply with all applicable legal requirements (including hygiene, health, and age regulations in their country)
- inform Users transparently about risks, care, and aftercare
Note: Artists act fully on their own responsibility. Tattoomii assumes no responsibility for the quality, legality, or execution of services.
6. Obligations of Users
Obligations
- not publish or transmit unlawful, offensive, or inappropriate content
- treat Artists respectfully and not harass them
- not store, copy, distribute, or commercially use platform content
- not provide Artists with false project information
Note: All communication and agreements between User and Artist constitute a private legal relationship for which Tattoomii assumes no responsibility.
7. Content & Copyright
7.1 Rights of Artists
By uploading content (e.g., images, videos, text), Artists grant Tattoomii a non-exclusive, worldwide, royalty-free license allowing Tattoomii to: display the content on the platform, use the content to promote Tattoomii (website, social media, newsletters), use the content for internal quality or safety checks.
7.2 Rights of Users
Users receive a simple, non-transferable right to view content. Any further use is prohibited.
7.3 Removal of Content
Tattoomii may remove content if: copyrights are violated, content is inappropriate, illegal, or misleading, these GTC are violated, complaints or legal notices are received.
Artist Guarantee: Artists guarantee that they hold all necessary rights to uploaded content.
8. Health & Safety
Tattoos are invasive procedures and carry health risks, including: infections, allergic reactions, wound healing complications, deviations from the desired aesthetic result, individual sensitivities.
Tattoomii Note: Tattoomii: does not provide medical advice, assumes no responsibility for health outcomes, does not guarantee quality or results of tattoo services, is not liable for damages resulting from tattoo services.
Risk Note: All health-related, artistic, and contractual risks lie solely with Artist and User.
9. Limitation of Liability
Tattoomii is liable only: for damages caused intentionally or through gross negligence, in cases of mandatory statutory liability.
Excluded: Tattoomii is not liable for: complications or outcomes of tattoo services, incorrect or incomplete information from Artists or Users, cancellations, rescheduling, no-shows, or disputes, indirect or consequential damages or loss of profit, damages caused by force majeure.
Platform Provider: Tattoomii acts solely as a platform provider and is not responsible for the content, services, or contracts between Artists and Users.
Liability Scope: Tattoomii is only liable for damages caused by intent or gross negligence, within the scope of statutory provisions.
Excluded Liability: Liability for indirect damages, consequential damages, and lost profits is excluded to the extent permitted by law.
No Liability For Incorrect Info: Tattoomii assumes no liability for incorrect or incomplete information provided by Artists or Users.
10. Fees & Future Paid Services
Current: The platform is currently free for Users and Artists.
Future: Tattoomii reserves the right to introduce paid services or expand existing offerings in the future. These may include, but are not limited to: subscriptions (e.g., Basic / Premium for Artists), increased visibility through sponsored placements or feature boosts, advertising space for studios, brands, or partners, studio and agency tools (team management, portfolio analytics, multi-artist administration), extended communication or customer management tools, booking or calendar features (if introduced in future), analytics and data services (trend insights, price ranges, style demand), integrations with third-party providers.
Changes: Tattoomii may introduce, modify, or expand paid services at any time. Price changes and new fee models will be communicated in advance.
11. Account Deletion & Suspension
Deletion: Users and Artists can delete their accounts at any time directly via profile settings. Alternatively, deletion can be requested by emailing hello@tattoomii.com.
Data On Deletion: Upon account deletion, personal data will be handled in accordance with statutory retention requirements. The following data may be affected: profile information and uploaded content will be removed, messages in existing chat rooms may be anonymised or deleted, reviews may remain in anonymised form, data linked to Instagram will be deleted in accordance with Meta's requirements, data held by third-party providers (e.g. Brevo contact lists) will be removed where technically feasible.
Deactivation: As an alternative to deletion, accounts can be temporarily deactivated. Deactivated accounts are not publicly visible but can be reactivated.
Suspension: Tattoomii may suspend or delete accounts without prior notice if: these GTC are violated, illegal, offensive, or misleading content is uploaded, repeated complaints are received regarding a User or Artist, fraud, abuse, or manipulation is suspected, required by law.
No Restore: Tattoomii is not obliged to restore deleted accounts or content.
12. Data Protection
Protecting personal data is important to Tattoomii. All information regarding the collection, processing, and storage of personal data can be found in our Privacy Policy at www.tattoomii.com/privacy.

Data Storage: User data (including images, messages, and profile information) is stored on third-party servers which may be located outside of Switzerland. Tattoomii ensures that all data processing complies with the requirements of the Swiss Federal Act on Data Protection (FADP) and, where applicable, the European General Data Protection Regulation (GDPR).
13. Third-Party Providers and Data Processing
To provide the platform and its features, Tattoomii works with the following third-party providers. Personal data may be transmitted to these providers:
Providers
13.1 Google
Google services are used for the following features: login via Google OAuth (Single Sign-On), location services and map display (Google Maps), calendar synchronisation (Google Calendar), video meetings for consultations (Google Meet), spam protection (Google reCAPTCHA). When using Google reCAPTCHA, technical data (e.g. IP address, browser behaviour) is transmitted to Google.
13.2 Meta / Instagram
Artists can link their Instagram account to Tattoomii to synchronise their portfolios. Publicly available Instagram content is imported during this process. Tattoomii implements the data deletion callback required by Meta for Instagram-linked data.
13.3 Brevo (formerly Sendinblue)
Brevo is used for sending transactional emails (e.g. verification codes, password resets, notifications) and for managing contact lists. Optionally, notifications may also be sent via WhatsApp through Brevo.
13.4 OpenAI
Tattoomii uses AI services from OpenAI to support certain features (see Section 15: Artificial Intelligence). User inputs (text, images) may be transmitted to OpenAI for processing.
13.5 Stripe
Stripe is used exclusively for calculating exchange rates. No user payment data is transmitted to Stripe.
13.6 Hetzner Online GmbH
The backend, databases, and file storage (images, videos, documents) are hosted with Hetzner in Germany (EU).
13.7 Vercel Inc.
The frontend (website) is hosted via Vercel (global Edge Network). Technical access data (IP, browser, referrer) is processed.
Consent Note: By using the platform, users consent to the processing of their data by the aforementioned third-party providers for the purposes described. Further details can be found in the Privacy Policy.
14. Communication and Notifications
Channels
14.1 Email Notifications
Tattoomii sends emails for the following purposes: email verification during registration, password resets, notifications about new messages and project requests, reminders about unread messages, profile completion reminders (Artists), contact form confirmations.
14.2 WhatsApp Notifications
Optionally, notifications about new messages, project requests, and reminders may also be sent via WhatsApp. Delivery is handled through the third-party provider Brevo. The WhatsApp notification feature can be disabled at any time.
14.3 Real-Time Communication
For the integrated messaging system, Tattoomii uses WebSocket connections to deliver messages and notifications in real time. These connections are protected by authentication.
15. Artificial Intelligence (AI)
Tattoomii uses AI technology (provided by OpenAI) to support certain features:

- Categorisation and style identification of tattoo ideas based on images and text descriptions in the price calculator
- Automatic generation of project titles based on descriptions or images
- Translation of content into different languages
- Image classification (e.g. tattoo vs. non-tattoo during Instagram synchronisation)
- Style assignment to Artist portfolios
Data Note: When using these features, entered text and uploaded images may be transmitted to the AI service provider (OpenAI). Processing is carried out in accordance with OpenAI's privacy policy.
Disclaimer Note: AI-generated results (e.g. categorisations, translations, price indications) are automatically produced and may contain inaccuracies. They serve solely as guidance and do not constitute binding statements.
Opt Out: The use of AI-powered features is optional in most cases. Users can configure tattoo projects manually without using AI assistance.
16. Analytics and Tracking
To improve the platform and user experience, Tattoomii collects anonymised and personalised usage data:
Data Collected
- Profile views and search behaviour
- Use of filters and platform features
- Interactions with the price calculator
- Page views and time spent on pages
- A/B test assignments for user interface optimisation
Technical Data: Technical data such as IP address, user agent (browser information), and referrer (source page) may be collected.
Purpose: This data is used exclusively to improve the platform, analyse usage trends, and optimise the offering.
Consent Note: Analytical cookies and marketing trackers are only used with the explicit consent of the user. Essential (technically necessary) cookies may be set without consent.
17. Changes to the GTC
Tattoomii may modify or update these GTC at any time to comply with legal requirements, functional adjustments, or new business models. Significant changes will be announced on the platform. Continued use of the platform after publication constitutes acceptance of the updated terms.
Right To Change: Tattoomii reserves the right to amend these Terms and Conditions at any time.
Notification: Users will be informed of changes in due time. Continued use of the platform after changes come into effect shall be deemed acceptance of the new terms.
18. Applicable Law & Jurisdiction
Governing Law: These GTC are governed exclusively by Swiss law. The place of jurisdiction is Zurich, Switzerland.
International: International Artists and Users are responsible for complying with the legal requirements of their home country.
Jurisdiction: The place of jurisdiction is Zurich, Switzerland.
Severability: If any provision of these terms is invalid, the validity of the remaining provisions shall not be affected.
